PRIVACY POLICY

 BRASILAGRO – COMPANHIA BRASILEIRA DE PROPRIEDADES AGRÍCOLAS and other companies belonging to its economic group (“BrasilAgro“), especially its controlled, associated, and subsidiary companies, is committed to protecting your privacy, in accordance with the General Law of Data Protection (“LGPD“) and any other data protection and privacy laws, as applicable (“Data Protection Laws“).

This Privacy Policy (“Policy“) explains, in a simple, transparent and objective manner, how BrasilAgro collects, stores, uses, processes, associates, protects, shares and other forms of treatment of the information that identifies or makes identifiable (“Personal Data“) visitors, suppliers, service providers and clients, as well as the legal representatives, employees and/or agents of these suppliers, service providers and clients, and users that access the website or other BrasilAgro electronic properties (“Holder(s)” or “You”).

This Policy shall be interpreted in conjunction with and in accordance with any other accompanying document, agreement, or privacy clause, as the case may be. Further notices and information may be sent to Data Subjects in connection with processing activities with their Personal Data.

This Privacy Policy is divided into six (6) sections and an appendix:

1.          COLLECTION AND STORAGE OF PERSONAL DATA 

BrasilAgro may collect the following Personal Data from the Holders

  • Personal information (such as full name, date of birth, gender, nationality, marital status, copy or numbers of government identification documents such as ID card number – RG, individual taxpayer number – CPF, national driver’s license number – CNH, national alien registration number – RNE, or passport information, when applicable);
  • Contact information (such as phone number, e-mail address, complete address, and communication preference);
  • Identifying information contained in articles of incorporation, bylaws and powers of attorney, related to the position, title or position held by the Holder;
  • Tax classification, banking and financial and credit information, as applicable;
  • Vehicle information (such as model and license plate number) to control access and parking at BrasilAgro’s facilities, when applicable;
  • Publicly available information in third-party databases, including government agencies;
  • Spouse identification information, when applicable and necessary for contract performance purposes;
  • Images collected for BrasilAgro’s security systems, such as photographs of registration and/or footage obtained from security cameras on BrasilAgro’s premises, at the applicable

Form of Collection. BrasilAgro’s Personal Data collected and handled by BrasilAgro is usually supplied by you when you register with us, fill out forms, contracts or in any other type of interaction with BrasilAgro, such as simulating operations or when you contact us by any means.

Note that in certain situations, such as when prospecting for a relationship or in order to meet the requirements for entering into a contract, BrasilAgro may also obtain your Personal Data from other sources, such as public websites or through background check providers and credit bureaus, in strict compliance with the applicable Data Protection Laws.

Data Collected Online. When accessing BrasilAgro’s websites or any other electronic property, as well as when establishing contact with us by any means, BrasilAgro may obtain additional information related to you, such as your access device, browser used, IP information, data on clicks, accessed pages or any search term typed in the websites or in reference to them, information on your profile without identifying you, geolocation, among others. If you prefer, You can manage this functionality through your device or web browser settings. The configuration of these technologies, however, may affect some resources offered by the website. BrasilAgro also includes third-party cookies on its websites.

Hyperlinks to other sites. BrasilAgro’s website may include links to third-party websites or other software applications or plug-ins. BrasilAgro is not responsible for the content or functionality of any of these external sites. Should an external site request your Personal Data, such information shall be handled according to the privacy policy of such site and not under this Policy.

Sensitive Data. According to the legal definition, Sensitive Personal Data are those related to: racial or ethnic origin, religious beliefs, political opinions, membership to unions or religious, philosophical or political organizations, data concerning health or sex life, genetic or biometric data (“Sensitive Data“). BrasilAgro does not collect Sensitive Data from the Data Subjects for the purposes described in this Policy.

Information of Children and Adolescents. The LGPD gives special protection to data of minors. In general, BrasilAgro only collects data from children and adolescents when they participate in social responsibility initiatives promoted by BrasilAgro or by its business partners. In these cases, BrasilAgro requires image use consent forms to be filled out, when applicable, as well as the consent of a parent or guardian of the minor, in compliance with the Data Protection Laws.

2.          PURPOSES AND DURATION OF TREATMENT

BrasilAgro performs Personal Data processing activities in accordance with the Data Protection Laws. Depending on the circumstances and the nature of our relationship with You, your Personal Data may be used for one or more of the following purposes:

  • For prospecting new business;
  • For the purpose of registration and other preliminary contracting procedures;
  • For the execution and operationalization of Agrarian Real Estate contracts involving the Holders;
  • For the execution and operationalization of various contracts, including, but not limited to, service contracts, leasing, purchase and sale, among others;
  • For the execution of social responsibility initiatives promoted by BrasilAgro;
  • For the performance of contractual obligations established between BrasilAgro and the Holders;
  • To allow the provision of assistance and ancillary services eventually related to the contracts established with the Card Holders;
  • In order to respond to authorities within the scope of legal or administrative proceedings, in compliance with legal, regulatory or any other duties legally required of BrasilAgro, or in defense of its rights and legitimate interests , including in legal or administrative proceedings;
  • To identify and register the Holder for access to BrasilAgro’s physical facilities and, as applicable, those of its business partners;
  • To answer requests and contacts of the Holders, as well as to receive complaints, investigate denunciations or respond to requests;
  • For the development of advertising and media material;
  • To carry out satisfaction surveys or surveys related to BrasilAgro’s business with Holders;
  • For the purpose of communication and relationship management with the Holders, and in order for us to contact the Holders, provide information, notifications, send communications, including those of an advertising nature, such as direct marketing, advertising and promotional actions; and,
  • To allow your navigation on BrasilAgro’s website and other electronic properties, including the analysis of your behavior on our website, the identification of problems, the customization of features and the monitoring of the security of .

BrasilAgro undertakes to keep the Personal Data as necessary to fulfill the purposes mentioned above and to discard the Personal Data whenever possible and as may be reasonably required, in compliance with the provisions of the Data Protection Laws. Should the Holder have any doubts on BrasilAgro’s Personal Data retention and disposal practices, he/she may contact the privacy channel with Personal Data Holders, by means of the e- mail: dpo@brasil-agro.com.

3.          SHARING OF PERSONAL DATA

BrasilAgro may share your Personal Data with third parties only when necessary for the purposes listed in this Privacy Policy and according to one or more of the cases listed below:

  • If the third party in question is one of BrasilAgro’s parents, subsidiaries or affiliates;
  • If the third party in question is a contractor, service provider or business partner performing Personal Data processing on behalf and in the interest of BrasilAgro, as its Personal Data Operator;
  • If the third party in question is an official public body or entity, regulatory, police or governmental authority, legitimately requesting information in the context of regular inspections, audits, legal processes or procedures and that constitute legal obligations binding on BrasilAgro, or when they are reasonably necessary to protect the rights of BrasilAgro;
  • When BrasilAgro has obtained the Holder’s free, unequivocal and express consent to share data.

4.          SECURITY MEASURES

BrasilAgro shall be responsible for adopting and maintaining reasonable security, technical and administrative measures to prevent irregular or unlawful treatment of the Holders’ Personal Data, including unauthorized access, destruction, loss, alteration or communication of the data.

All BrasilAgro’s employees are subject to confidentiality obligations. Additionally, BrasilAgro updates and tests its security systems according to the best practices in order to protect your Personal Data.

The processing activities of the owners’ personal data may be carried out outside the national territory. Although these countries may have different data protection levels than Brazil, BrasilAgro will adopt safeguards, including contractual safeguards, to maintain the rights of the data subjects, confidentiality, integrity and security of information.

5. RIGHTS OF THE PERSONAL DATA SUBJECT

 The following rights of the Personal Data Holder may be exercised at any time, in accordance with applicable law, by Data Subjects upon request:

  • confirmation of the existence of processing of Personal Data;
  • access to Personal Data;
  • correction of incomplete, inaccurate or outdated Personal Data;
  • anonymization, blocking or deletion of unnecessary, excessive data or data processed in violation of the provisions of the LGPD;
  • portability of Personal Data to another provider of a service or product, subject to regulation by the national authority;
  • request for erasure or anonymization of Personal Data processed on the basis of your consent, except where the law authorizes the retention of such data on another basis;
  • information on public and private entities with which BrasilAgro has shared the use of your Personal Data;
  • information about the possibility of not giving consent to the processing of your Personal Data and the consequences of such action; and
  • revocation of his or her consent, when the processing has been done on the basis of the data subject’s

How to exercise your rights? BrasilAgro shall facilitate the exercise of rights by the Holders, whenever possible and pursuant to the terms of the law. BrasilAgro has a specific communication channel to manage the communications with Holders and enable the exercise of rights.

Data Subjects may make any complaints, requests or inquiries regarding the processing of their Personal Data, including for exercising the rights indicated in this Privacy Policy and guaranteed by national law, by sending an e-mail to dpo@brasil-agro.com or at the following address, to the attention of the Personal Data Protection Officer:

When the data subject contacts BrasilAgro to exercise his or her rights as a data subject, BrasilAgro may collect information to confirm the identity of the data subject, to the extent of its interest and safety.

POLICY UPDATES

This Privacy Policy may be updated from time to time.

All amendments shall be deemed immediately applicable and in force, except in the case of any communication to the contrary sent by BrasilAgro to the data subjects.

BrasilAgro shall take reasonable measures to notify the Holders of updates to the Privacy Policy.
